By accessing or using Workingo, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Introduction

These Terms & Conditions ("Terms") govern access to and use of the Workingo mobile application (together, the "Platform"), operated by Priti Rane, trading as "Workingo" ("Workingo", "we", "us", or "our"), a sole proprietorship with its principal place of business at 1101, Regent Galaxy, Jankalyan Nagar Road No. 1, Kharodi, Malad West, Mumbai – 400095, India.

By creating an account or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Workingo connects Job Seekers and Recruiters/Employers directly. The specific rules governing how Job Seekers and Recruiters interact with each other on the Platform (job postings, applications, reporting, and related conduct) are set out in our User Agreement, which forms part of these Terms by reference. Where there is a direct conflict between this document and the User Agreement on a matter the User Agreement specifically addresses, the User Agreement governs for that matter.

2. Eligibility

2.1 You must be at least 18 years old to create an account or use the Platform in any capacity.

2.2 You must provide accurate, current, and complete information, including a valid Indian mobile phone number, and keep it up to date.

2.3 The Platform is currently intended for use within India.

3. Account Registration and Security

3.1 Accounts are created using your mobile phone number verified by a one-time password (OTP). Repeated OTP requests are subject to a 60-second cooldown between attempts.

3.2 Each registered mobile number is associated with a single role — either Job Seeker or Recruiter, not both. If you wish to use the Platform in both capacities, you will need to register using two different phone numbers, each under its own account.

3.3 After submitting your profile, it is reviewed by our team, typically within 24 hours. If your profile is rejected, you will be shown the reason for rejection within the app and may correct and resubmit it.

3.4 You are responsible for all activity on your account and for keeping your phone number secure. Notify us immediately if you suspect unauthorized access.

3.5 We may reject, suspend, or terminate an account at our discretion, including where information is inaccurate or misleading, or where these Terms or the User Agreement have been violated.

4. Fees

4.1 Workingo does not currently charge commission, listing fees, or subscription fees to Job Seekers or Recruiters. This fee-free structure will remain in effect until further notice and may be updated in the future at Workingo's discretion.

4.2 After this initial period, Workingo may introduce fees, paid features, or subscriptions. If we do, we will provide advance notice within the app and update these Terms before any such fee applies to your continued use of a feature. Nothing in this Section obligates Workingo to keep any specific feature free indefinitely.

4.3 As of the date of these Terms, no payment processor is in use, since no paid feature is live. This section will be updated with processor and billing details before any paid feature launches.

5. Advertising

5.1 The Workingo mobile app displays advertisements served through Google AdMob. This may involve collection of your device's advertising identifier and other technical data by Google, used to serve and measure ads. See our Privacy Policy for details and your choices.

6. Acceptable Use

You agree not to:

• Provide false or misleading information in your account, profile, or any content you submit;
• Use the Platform for any unlawful purpose, or to solicit or facilitate unlawful activity, including any scheme requiring a Job Seeker to pay money as a condition of being hired;
• Harass, threaten, discriminate against, or defraud any other user;
• Upload or submit content that is obscene, defamatory, infringing, or otherwise unlawful;
• Attempt to access another person's account or use another person's phone number without authorization;
• Circumvent, disable, or interfere with the security or proper functioning of the Platform, including attempting to access administrative systems without authorization;
• Scrape or extract data from the Platform using automated means without our written permission;
• Hold more than one account, or hold a Job Seeker and Recruiter account under the same phone number.

7. Intellectual Property

7.1 The Workingo name, logo, app, website, and underlying software are the property of Workingo and are protected by applicable intellectual property laws. These Terms do not grant you any right to Workingo's trademarks or branding except as necessary to use the Platform as intended.

7.2 You retain ownership of content you submit to the Platform (such as your profile information and any Success Story you share with us), subject to the license described in the User Agreement.

8. Suspension and Termination

8.1 We may suspend or terminate your account, with or without notice, where we reasonably believe these Terms or the User Agreement have been violated, where information provided is false, or to protect the safety or integrity of the Platform or its users.

8.2 You may request deletion of your account at any time from the app's Settings screen or via the account deletion form on our website. Once submitted, this request takes effect immediately: your account is signed out and cannot be used to sign in again, and there is currently no grace period and no way to cancel the request. Deletion is typically completed within 24 hours, at which point your account data is removed. The phone number used may be registered again after a 30-days waiting period.

8.3 Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

9. Disclaimers

9.1 THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9.2 Job listings publish immediately upon posting and are not reviewed before going live; Workingo may review and remove a listing after publication, including in response to a report. Workingo does not guarantee the accuracy of any job listing, profile, or Success Story, or that any Job Seeker will find work or any Recruiter will find a suitable candidate.

9.3 Profile approval by Workingo is a one-time review at submission and does not constitute an ongoing guarantee, endorsement, or background check of the user or their subsequent activity on the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, Workingo (including the proprietor and any employees or agents) will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of income, profits, or opportunities, arising from your use of the Platform or any interaction with another user, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Workingo from claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or the User Agreement, your misuse of the Platform, or content you submit.

12. Third-Party Services

The Platform relies on Google/Firebase infrastructure (hosting, authentication, notifications, analytics, and advertising via AdMob). We are not responsible for the availability or practices of these or any other third-party service you may interact with (such as an Employer's own phone line).

13. Changes to These Terms

We may update these Terms at any time. Material changes will be reflected by an updated "Last updated" date and, where reasonably practicable, an in-app notice. Continued use after changes take effect means you accept the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
